Terms of Sale

All Customers:
All orders are firm sale only.
If selecting ‘Pay Now’, the payment must be made immediately and will be taken in the currency stated at checkout.
If selecting ‘Request Invoice’:
- For subscription renewals, payments are due on the first day of the new subscription period.
- Payments for all other SCIS products including for new subscriptions are due within 14 days of invoice date.
All payments must be made in the currency stated on your invoice.
Notification of incorrect invoices must be made to Education Services Australia within 7 days of the invoice date.
Prices are subject to change without notice.
SCIS Subscription Orders
SCIS Subscription Orders are twelve month standing orders and are effective from the first day of the subsequent month. Customers who subscribe midway through the year will receive the current calendar year pricing for the full twelve month subscription period. Product use is subject to the copyright requirements as provided in the relevant terms of use.
Barcode Scanners
Barcode scanners are only available for customers located in Australia.
Notification of incorrect supply or damaged goods must be made to Education Services Australia within 7 days of the invoice date. Authority to return goods must be obtained from Education Services Australia staff prior to any return.
Professional Learning
Registration and Cancellation Policy
Submission of the online booking form is considered a firm registration unless a note is made on the form that user approval is required. Users will be invoiced prior to the professional learning event. Please indicate on the form if you require a personal rather than a user invoice.
Workshops
The workshop cost includes materials and light catering.
Registration is charged per person. Fees for registrations cancelled less than 14 days before the workshop date, and for all non-attendees, are not refundable. However, a substitute person may attend.
Webinars
Registration is charged per person, per session. Once invoiced, ESA will not accept cancellations. Webinars delivered via GoToWebinar will have a cancellation link in their notification emails. Clicking on this link will not cancel the invoice.
Disclaimer
Product information in SCIS brochures and on the SCIS website is provided in good faith and is current at time of publication. The contents of SCIS brochures and the SCIS website are subject to change at the sole discretion of Education Services Australia.
To the extent lawful:
- Education Services Australia gives no other warranty, express or implied, and will not be liable for any loss (including consequential loss) or damage of any nature from the use or inability to use SCIS products; and

Governing Law
These terms of sale are governed by and construed in accordance with the law of Victoria and the parties submit to the jurisdiction of the courts and tribunals of that State.

Definitions and Interpretation
Authority Files: the Authority Files product or any part of it;
Book Cover Images: the book cover images available on SCIS Data;
ESA: Education Services Australia Limited which owns and/or has rights to license SCIS Products;
Enhanced Content: the additional content (excluding Book Cover Images) that can be viewed but not downloaded for each record in SCIS catalogue;
Including: is not a word of limitation and is not intended to be limited by specific examples;
Library: the library of the School which is authorised by ESA to access SCIS Products in accordance with these terms of use;
Library System: an electronic library system used in the Library;
Records: the records downloaded, imported or copied pursuant to clause 1(b);
SCIS Data: the SCIS data product or any part of it;
SCIS Products: either SCIS Data or SCIS Data and Authority Files depending upon whether or not the User has subscribed to SCIS Data only or SCIS Data and Authority Files;
SCIS Website: means the website https://www.scisdata.com/;
User: the school or organisation specified in the SCIS Products subscription order form which has agreed to these terms of use; and
Subscription Period: twelve months.
Terms of Use
1. Subject to these terms of use, for the Subscription Period:
(a) ESA grants to the School a non-exclusive, non-transferable right to:
(i) access the SCIS Products; and
(ii) download, import or copy Records from the SCIS database for use only within the Library; and
(iii) copy Book Cover Images from SCIS Data for use only:
(a) on the School’s online library catalogues;
(b) on the School's website including blogs, wikis, online newsletters and school intranet; and
(c) within the School.
(b) where the School has subscribed to Authority Files, download and import Authority Files from the SCIS Website for use only:
(i) on the School’s online library catalogues; and
(ii) within the School.
(c) The School must not decompile, disassemble or reverse engineer Authority Files, or permit any third party to do so.
(d) On request from ESA the School will authorise ESA to allow the School’s supplier to access its SCIS account to download records on its behalf.
2. Subject to clause 3, ESA:
- owns the intellectual property in the Records; and
- retains all rights to SCIS Products.
Except as permitted by these terms of use, the User must not exercise any of the exclusive rights of ESA as intellectual property owner in relation to the SCIS Products, including copy, distribute, sell/onsell or transfer the Records (including any part of a Record), or permit any third party to do so.
3. Relevant copyright owners retain all rights to the:
- Book Cover Images. Except as permitted by these terms of use, the User must not exercise any of the exclusive rights of the copyright owners in relation to the Book Cover Images, including, copy, distribute or transfer the Book Cover Images or permit any third party to do so; and
- Enhanced Content. Where the copyright owner is a third party, the relevant copyright owner’s terms of use (Syndetics, LibraryThing for Libraries) govern use of the Enhanced Content.
4. The User must take all reasonable steps to preserve the confidential nature of SCIS Products.
5. ESA may terminate access to SCIS Products:
(a) at any time by informing the User in writing of termination; or
(b) immediately if the User commits any breach of the terms of use, including infringing the copyright of the Records, Book Cover Images or Enhanced Content.
6. If access to SCIS Products is terminated pursuant to clause 5, the User will immediately, destroy or return to ESA all copies of the SCIS Products including Records, Book Cover Images and Enhanced Content and, at the request of ESA, provide written assurance to ESA of compliance with this clause 6.
7. Upon commencement of subscription to SCIS Products, the User must:
- immediately choose a secure alternate password to the default password issued by ESA;
- secure their subscriber user name and password.
8. The User and all people within the User with access to the User’s SCIS username and password must not divulge or communicate the User’s subscriber user name or password to any third party or assist or allow any third party to access SCIS Products without ESA’s consent.
9. Without limiting clause 12, the User agrees to undertake virus scanning and virus checks necessary to ensure that any material downloaded from SCIS Products will not corrupt its data or software systems.
10. ESA provides a limited warranty that accessibility and usability of SCIS Products will be substantially in accordance with the description of SCIS Products at https://www.scisdata.com/products/scis-data/ and, if applicable, https://www.scisdata.com/products/authority-files/ .
11. To the extent that:
(a) ESA breaches the limited warranty provided in clause 10; or
(b) ESA's liability cannot be lawfully excluded,
the User’s exclusive remedy is, at ESA's option, full or unexpired subscription credit with ESA of the subscription price paid, or resupply of the SCIS subscription.
12. To the extent lawful, ESA gives no other representation or warranty with respect to SCIS Products, either express or implied including, but not limited to, performance, merchantability or fitness for a particular purpose, and assumes no responsibility for the accuracy of the information on SCIS Products, application errors, omissions or viruses. The entire risk in relation to the results and performance of SCIS Products is assumed by the User. ESA will not be liable for direct, indirect, special, incidental or consequential damage arising out of the use or inability to use SCIS Products, even if ESA is notified by the User of the possibility of such damages. Specifically, ESA is not liable for any costs including those incurred as a result of lost profits or revenue, loss of the use of the SCIS Products, loss of data and equipment, of data or claims by third parties.
13. Clauses 2, 3, 6 and 12 survive termination or expiry of these terms of use.
14. If the User uses a cloud based system where catalogue records are shared or collective, then it may transfer the Records to such system provided that:
(a) informs ESA of the intention to do so, and
(b) ensures that content in the MARC fields: 082, 380, 385, 5xx, 6xx and 852 of the Records is not shared and is available only to the User.
15. The User agrees to ensure the following content, where such fields exist, is not edited or deleted:
(a) MARC field 003 or 035 where the code au-mesci is displayed;
(b) MARC field 038 where the code au-meesa is displayed;
(c) MARC field 040; and
(d) The codes scot or scisshl in 6xx MARC fields.
16. These terms of use are governed by the laws of Victoria.

2. SCIS Website Terms of Use
The Schools Catalogue Information Service (SCIS) provides a central cataloguing service for school libraries. SCIS is a business unit of Education Services Australia Limited (ESA), a national, not-for-profit company established by all Australian Ministers of Education.
Use of the website
Your use of the SCIS website is subject to these terms of use. If you do not agree to these terms of use, you must not use the SCIS website.
Copyright
Unless indicated otherwise, the material on the SCIS website is owned by ESA,

For all ESA owned material on the SCIS website, provided acknowledgement is made to the source, schools are permitted to copy material freely for communication with teachers, students, parents or community members. No part may be reproduced for any use other than that permitted under the Copyright Act 1968 without written permission from the SCIS Unit at Education Services Australia Ltd.
Images of libraries were taken at Melbourne High School and Camberwell Girls Grammar School.
Many of the catalogue records displayed in SCIS catalogue for books also display a cover image. A licence arrangement with Thorpe Bowker allows ESA to display book cover images in the SCIS database. Unless you are have agreed to relevant terms of use for SCIS Data or SCIS Data and Authority Files, you may only view book cover images in the SCIS database.
Enhanced descriptive data displayed in SCIS catalogue may be provided by third parties and this content is labelled with terms of use specific to the data.
Users of SCIS products are required to accept the terms of use relevant to their type of access at the time of signing up.

- Exclusion of Warranties and Indemnities
To the extent lawful, ESA:
- excludes all warranties in respect of the SCIS website and any content available on it; and
- is not liable for any loss or damage however caused resulting from the use of the SCIS website; and
- will not be liable for any incidental, special or consequential damages of any nature arising from the use of or inability to use the SCIS website or any content available on it.
3. SCIS Terms of Use for Free Trial
Please note that no-one is authorised to access SCIS Data as a trial user without agreeing to be bound by these terms of use.

Library: the library of the School which is authorised by ESA to access SCIS Data in accordance with these terms of use;
Library System: an electronic library system used in the Library;
Records: the SCIS records downloaded, imported or copied pursuant to clause 1(b);
SCIS Data: the SCIS Data product or any part of it; and
School: means the school specified in the SCIS Data subscription order form which has agreed to these terms of use.

(b) download, import or copy up to 20 SCIS records from SCIS Data for use only within the Library; and

(iii) within the School.
2. Subject to clause 3, ESA:

SCIS Data: the SCIS Data product or any part of it;
Teaching: teaching library and information studies at the Tertiary Institution; and
Tertiary Institution: the tertiary institution where the Lecturer teaches.
Terms of Use
1. Subject to these terms of use, for the Access Period, ESA grants to the Lecturer a non-exclusive, non-transferable right to:
(a) access SCIS Data; and
(b) download, import or copy 50 Records from the SCIS database for use only by the Lecturer for their Teaching; and
(c) access and view Book Cover Images from SCIS Data for use only by the Lecturer for their Teaching.
2. Subject to this clause 2, the Lecturer must not import the Records into the Library System. If the Lecturer is required to import the Records into the Library System as part of fulfilling their Teaching requirements, the Lecturer must delete the Records from the Library System as soon as they have fulfilled their Teaching requirements.
3. Subject to clauses 4, ESA:
- owns the copyright in the Records; and
- retains all rights to SCIS Data.
Except as permitted by these terms of use, the Lecturer must not exercise any of the exclusive rights of ESA under the Copyright Act 1968 (Cth) in relation to SCIS Data, including copy, distribute or transfer the Records, or permit any third party to do so.

(b) immediately if the Lecturer commits any breach of these terms or use, or infringes the copyright of the SCIS Data including the Records, the Book Cover Images or the Enhanced Content.
7. If access to SCIS Data is terminated pursuant to clause 6, the Lecturer must immediately, destroy or return to ESA all copies of the Records and the Book Cover Images and, at the request of ESA, provide written assurance to ESA of compliance with this clause 7.

11. ESA provides a limited warranty that accessibility and usability of SCIS Data will be substantially in accordance with the description of SCIS Data at https://www.scisdata.com/products/scis-data/.
12. To the extent that:

(b) ESA's liability cannot be lawfully excluded,
the Lecturer's exclusive remedy is resupply of their complimentary access.

5. Terms of Use for Complimentary Access - Tertiary Student

Tertiary Institution: the tertiary institution where the Student is enrolled.

1. Subject to these terms of use, for the Access Period, ESA grants to the Student a non-exclusive, non-transferable right to:
(a) access SCIS Data; and
(b) download, import or copy 50 Records from the SCIS database for use only by the Student for their Studies; and
(c) access and view Book Cover Images from SCIS Data for use only by the Student for their Studies.
2. Subject to this clause 2, the Student must not import the Records into the Library System. If the Student is required to import the Records into the Library System as part of fulfilling their Study requirements, the Student must delete the Records from the Library System as soon as they have fulfilled their Study requirements.

- owns the copyright in the Records; and
- retains all rights to SCIS Data.

(b) immediately if the Student commits any breach of these terms or use, or infringes the copyright of the SCIS Data including the Records, Book Cover Images or Enhanced Content.
7. If access to SCIS Data is terminated pursuant to clause 6, the Student must immediately, destroy or return to ESA all copies of the Records and the Book Cover Images and, at the request of ESA, provide written assurance to ESA of compliance with this clause 7.
8. Upon commencement of the Access Period the Student must:
- immediately choose a secure alternate password to the default password issued by ESA; and
- secure their access user name and password.
9. The Student must not divulge or communicate their access user name or password to any third party or assist or allow any third party to access SCIS Data.
10. Without limiting clause 13, the Student agrees to undertake virus scanning and virus checks necessary to ensure that any material downloaded from SCIS Data will not corrupt the data or software systems of the Student.
11. ESA provides a limited warranty that accessibility and usability of SCIS Data will be substantially in accordance with the description of SCIS Data at https://www.scisdata.com/products/scis-data/.
12. To the extent that:
(a) ESA breaches the limited warranty provided in clause 11; or
(b) ESA's liability cannot be lawfully excluded,
the Student's exclusive remedy is resupply of their complimentary access.
13. To the extent lawful, ESA gives no other representation or warranty with respect to SCIS Data, either express or implied including, but not limited to, performance, merchantability or fitness for a particular purpose, and assumes no responsibility for the accuracy of the information on SCIS Data, application errors, omissions or viruses. The entire risk in relation to the results and performance of SCIS Data is assumed by the Student. In no event will ESA be liable for direct, indirect, special, incidental or consequential damage arising out of the use or inability to use SCIS Data, even if ESA is notified by the Student of the possibility of such damages. Specifically, ESA is not liable for any costs including those incurred as a result of lost profits or revenue, loss of the use of the SCIS Data, loss of data and equipment, of data or claims by third parties.
14. Clauses 2, 3, 7 and 13 survive termination or expiry of these terms of use.
15. If the Student uses a cloud based system where the Records are shared or collective then they may transfer the Records to such system provided that they:
(a) inform ESA of their intention, and
(b) ensure that content in the MARC fields: 082, 380, 385, 5xx, 6xx and 852 of the Records is not shared and is available only to the Student.
16. The Student agrees to ensure the following content, where such fields exist, is not edited or deleted:
(a) MARC field 003 or 035 where the code au-mesci is displayed;
(b) MARC field 038 where the code au-meesa is displayed;
(c) MARC field 040; and
(d) the codes scot or scisshl in 6xx MARC fields.
17. These terms of use are governed by the laws of Victoria.
